the judges of the constitutional court (CC) of Russia has declared unconstitutional the rule that the driver escaped from the scene of the accident until the police arrive, can not be considered drunk according to testimony or other evidence. On Wednesday, April 25, reports the press service of the court.
“the Rule does not provide the possibility of recognition of the driver being intoxicated, if he fled the scene of the accident. This puts them in a more advantageous position compared to the drivers remaining at the crash site. (…) This part of this Statute is inconsistent with the Constitution”, — stated in the message.
As noted TASS, now the legislators have a year to change existing norms. Prior to the amendment will continue the current procedure, that is, the driver escaped from the accident scene to a medical examination, will not be recognized as drunk, even if he had consumed alcoholic beverages before getting behind the wheel.
