French designer shoes Christian Louboutin to get exclusive rights to a bright red sole. About it reports Bloomberg.
the European court of justice in Luxembourg took the decision on Tuesday, June 12.
In 2012, Louboutin first filed a lawsuit in the district court of the Hague against the Shoe brand Van Haren, also using red soles. The court sided with the designer, and temporarily banning the company to sell such shoes.
In 2014, Van Haren filed a complaint to the court of appeals, which asked for advice in court.
the advocate General of the European court of justice Maciej Szpunar thought that the French designer does not have exclusive rights on the sole, since the color can not be considered the registered trademark and is not subject to protection under intellectual property rights.
Then, in the court of justice noted that the opinion Sunara is not equal to the opinion of the court, and said that the final decision will be rendered later.
